Fee schedules for the legal aid filing fee surcharge are codified in sections 1901.26, 1907.24, and 2303.201 of the Revised Code.
Key components of these statutes include:
Assessing and collecting the $26 filing fee surcharge ($11 on small claims) on new civil actions and proceedings at the time the case is filed (except on inter-governmental cases, in which the fee may be collected from the defendant following judgment);
Not waive the legal aid fund surcharge unless other all filing fee surcharges are waived;
Assessing an $15 surcharge (the difference between the $11 already collected and $26 surcharge for new civil cases) on cases moving from the small claims to general civil docket;
Remitting surcharges collected to the Treasurer of State on or before the 20th of the month following the month in which they were collected; and
Completing each section of the Treasurer of State's remittance form, including the number of cases assessed the $26, $15, and $11 surcharge, as well as the number of cases in which the surcharge was waived.
